Abstract

This paper deals with the difference between the private prison of freedom and torture. The latter is practiced in prisons, in many ways, even if the penalty is only deprivation of liberty. Emphasized the contrast of the Brazilian law against the reality of practice. Early on, it was exposed on the historic prison in some times and places. After that, I had intended to reflect on prison reality in Brazil and its consequences. So, I tried to bring a legislative content satisfaction prisoners' rights in the face of torture reality. Not only raise problems, I worried also about bringing alternatives to minimize torture in prisons.
